Terms of Service (TOS)
1. Information Collection
The information we collect from our clients will be used to maintain services between the client and us, and to represent the quality of our work to others, such as in our online portfolio.
2. Ownership of Web & Mobile Design
Upon completion of a custom web or mobile design and full payment, the client becomes the owner of the commissioned website or mobile application.
The client may continue to use the commissioned product to promote their company or organization.
Reselling the design or development to other companies is not permitted.
The client may add pages themselves or hire another company to add them.
Reusing our work in another design that credits a different company is not allowed.
3. Ownership of Website Domain Name
Domain names are leased from registration companies.
If we register a domain name, it will be in the client’s name.
Upon payment of outstanding costs, the client retains the right to use the domain.
Renewal and costs are the client’s responsibility.
If we renew on behalf of the client, additional fees apply.
We are not responsible for expired domain names.
4. Ownership and Copyright
All text and photos must be provided by the client (unless content services are purchased).
Clients must ensure ownership or permission for submitted content.
Clients are responsible for ensuring no trademark, copyright, or service mark infringement.
We are not responsible for intellectual property issues caused by client content.
5. Project Initiation
Project initiation requires:
An initial design/development payment.
Client logo or required design elements.
6. Development Phase
Begins after client approval of the mock-up and submission of all content and access details.
Turnaround depends on project size and queue.
7. Project Timeliness & Client Requirements
Clients must provide timely feedback and content within 10 business days. Otherwise:
7.1 Mock-up Feedback
No response means automatic approval. Later changes may cost extra.
7.2 Sitemaps/Page Names
Default names assigned. Changes later may incur charges.
7.3 Client Logo
A substitute may be used if not provided. Changing later may cost extra.
7.4 Photos
Substitute photos may be used if originals are not provided. Changing later may cost extra.
7.5 Homepage Text
Must be provided by the client. Other pages may use placeholder text.
If 30 days pass without required input, we may consider the project complete and bill accordingly.
8. Content Submission Guidelines
Text must be provided as actual text (not images).
Files must be clearly labeled by page name.
Content cannot be sent by fax or paper (unless approved with surcharge).
9. Design & Development
After mock-up approval, only minor changes are allowed.
Subpages follow the homepage design (mock-ups not provided).
Specific subpage requests must be made at contract signing (may add cost).
10. Website Updates & Maintenance
Clients with a maintenance plan get discounted rates.
Standard plan covers small updates (e.g., 5 photos + short text).
Routine updates are usually done in 3–4 business days.
Requests beyond the plan are quoted separately.
Clients without a plan are charged full hourly rates.
Maintenance cost is separate from hosting and can be cancelled anytime.
11. Payment Policies
Project Cost: 50% due at initiation, remaining balance within 5 business days of completion.
Going Live: Website goes live only after full payment.
11.1 Late Payments
10% penalty after 10 business days.
Reported to credit bureau after 30 days.
Sent to collections after 60 days.
12. Termination of Services
If the client cancels mid-project, they are responsible for completed work.
Refunds may be full, partial, none, or additional payment required—depending on progress.
Termination must be requested in writing.
13. Changes to Terms of Service
Pixels Horizon reserves the right to amend, update, or expand these terms and disclaimers at any time without prior notice. Users are advised to regularly review this page to stay informed of any changes.
13.1 Interpretation of Missing Clauses
Any clause missing from this policy, whether intentional or unintentional, shall be interpreted in favor of Pixels Horizon.
If a similar clause is found on another website’s policy but not explicitly stated here, it may still be applied for the company’s benefit.
All rights are reserved by Pixels Horizon in relation to its website, policies, and content.
13.2 Legal Safeguard Clause
We explicitly state that no legal proceedings may be initiated against Pixels Horizon on the basis of any missing or incomplete policy clause simply because such clauses exist on other, more established websites. Any attempt to use this website’s policies against us in bad faith or with malicious intent shall be deemed invalid.
